DISCLAIMER

By purchasing my (ImpishlyJynxed) services (Digital Art), you automatically agree to the following conditions as well as my rules which are public and will be reminded as necessary.Please read this entirely and carefully. I will refuse your commission if you do not agree to these terms.If you are not comfortable with my Terms Of Service and/or are not willing to agree to the conditions, you may not request a commission.

SECTION I. IMAGE COPYRIGHT & USAGE POLICY

I. I, the artist (ImpishlyJynxed), retain full and exclusive rights to the original and commissioned artwork. The client may not claim it as their own or use it for anything other than personal use.II. I (ImpishlyJynxed) reserve the right to include the artwork in my portfolio.III. I (ImpishlyJynxed) reserve the right to post the commissioned work on my social media unless requested otherwise. (See SECTION. V)IV. I (ImpishlyJynxed) reserve the right to refuse or discontinue a commission at any time.V. Any characters (Original or Canon Character of Books/Fanfiction, Video Games, Webtoon, Art, ETC.) portrayed in the commissioned work remain copyrighted to their rightful owners.VI. All commissioned artwork is for noncommercial purposes only. Redistribution of my artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited.VII. In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.

SECTION II. USER AGREEMENT

I. By commissioning me, you agree that you have read and accepted all the terms described herein.II. You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.III. Please be kind. Any aggressive, rude, or inappropriate behavior against me during the process will result in me canceling the commission. You will be refunded for the commission upon cancellation by me, but I will be keeping 50% of the total payment.IV. If these terms are broken, violators will be added to a blacklist indefinitely and without warning with any additional appropriate actions taken.

SECTION III. GENERAL CLIENT

I. Conditions for Reposting:

i. The client has my permission to repost the artwork wherever they would like, as long as proper credit is given and my watermark/signature remains intact and unalteredii. You may use the Artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.iii. You reserve the right to print or create an otherwise physical reproduction of the Artwork as long as it is for your PERSONAL use only (ie. NOT for sale).iv. Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.

II. Prohibited Actions:

i. You may not claim my artwork as your own.ii. You may not put my work into any A/I engine.iii. These clients are permitted to include signatures and/or watermarks indicating the Artwork is my intellectual property. Credit in some form is required.iv. Altering my artwork in any way without asking for permission beforehand, with the exception of cropping/resizing the image for an icon or other use.v. Any harassment in an attempt to bargain for a commission (a ‘slot’) is not tolerated. This includes inappropriately worded comments on any of my social platforms, as well as private messages. I reserve the right to place anyone on a blacklist over harassment.vi. You are NOT authorized to trace over my Artwork in any way, including the use of the artwork as a “base.”vii. You may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed.viii. You are NOT authorized to change, modify, edit or use my works without my permission.
You may not color my sketches or lineart, unless you collaborate with me.ix. You are not permitted under any circumstances to use any part of commissioned work from robboyblunder such as images, goods, and copies of goods in any block-chain-related technology including non-fungible tokens (NFT), cryptocurrency, or future inventions in the space. Using any commissioned work is also strictly prohibited from use in any advertising or profits associated with block-chain related technology including non-fungible tokens (NFT), cryptocurrency, or future inventions in the space.x. Any aspect of work by robboyblunder may not be used to train, validate, or test any neural network or artificial intelligence. Doing so is in violation of terms against alteration and external non private use of assets created for patrons and/or post-commission.

SECTION IV. PAYMENT INFORMATION

For your protection and mine:
I. I will need your email to use payment processing platforms.II. I will never use your information or name beyond the payment forms between us, and I will never share or mention it to you (unless there is an issue with it) or anyone without your express permissionIII. Any emails, private messages, and comments that you send must be in English. Miscommunication due to mistranslation is at fault of the client if they cannot communicate in English.IV. I accept payment in USD. All USD payments will be taken via Paypal (PAYPAL DISCLAIMER: Please note that all of my sales are “Digital Artwork” and it is the Artwork’s “Intellectual Property” that is purchased by you, the Client) or Artree only.V. Payments via Paypal are sent via Invoice method only unless otherwise stated, but do not require an account to pay. I will cover the Paypal fees as it is expected from the Artist per PayPal ToS. What you see is what you will have to pay.VI. I do not accept payment from shared PayPal accounts unless you are not of legal age and use a parent/guardian’s PayPal account.VII. I am not responsible for any mistakes that are made on your part over the course of the transaction.VIII. It is expected that you will deposit 100% (Sketches) or 50% (Lineart or up) must be paid before I start working. Once the sketch is approved, the remaining balance must be paid in full before I continue working and finish up your request. No exceptions unless otherwise discussed for more expensive orders.IX. I will initiate the transaction to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment. Failure to comply will result in refund and potential cancellation of your commission.X. By paying an invoice sent to you, you automatically accept that you are paying for a digital product/service, so it’s impossible to get a physical item. You also agree to give up any attempts of chargeback, as you are confirming your access and/or ownership of the payment account related to the email provided.XI. You are also confirming that you are the owner of this account and money or have permission to use it fully.XII. Non-payment within 48 hours will result in the commission being cancelled. Progress up to this point, if any, will be repurposed as a YCH.XIII. It is the commissioner's responsibility to tell me when the payment has been sent. Sometimes payment will not go through, and I won't know about it. If you fail to tell me that you've sent the payment within 48 hours - and I know I absolutely haven't received the payment - then the 48-hour payment term applies to you.XIV. If payment is not made in a timely manner (48 hours unless discussed otherwise) after I’ve placed the Invoice, the commission will be cancelled. Please contact me if there are any delays or issues preventing payment. Repeated counts of commissioning a project and failing to pay will result in blacklisting.XV. Your Payment within 48 hours paid for Art, your commission slot as is confirmed.

SECTION V. NDA - PRIVACY REQUEST

I. If you wish for your request to be private, it must be stated during the ordering process.II. I reserve the right to charge a fee if I deem fit.III. The privacy request entails that I am not allowed to share any WIPs on social media, nor am I allowed to stream the process of the commission anywhere.IV. However, this also means that you must refrain from sharing any such spoilers and details yourself.V. If applicable, an NDA fee usually starts at +5% of the total quote, but it might differ. The bigger the project the bigger the fee.

SECTION VI. DEADLINE

I. You reserve the right to set a deadline for your commission and deadlines must be agreed upon prior to the start of the commission.II. I reserve the right to take up to 1-3 weeks to begin work on your project, and an additional 3 days-2 weeks days to work on said project as needed.III. If you did not alert me to a deadline, you must not send reminders until this 4 week’s buffer period has passed. Reminders will be ignored if they relate to work that I have prioritized above your project, including other commissions and gift art.IV. I will always do my best to complete your commission within a timely manner, but please understand that sometimes life may get in the way and cause a delay in completing your commission.V. No harassment over my work speed will be tolerated, regardless of the time that has passed. No Exception.VI. I will notify you as soon as possible of any issues that come up to keep you informed.

SECTION VII. REFUND POLICY

I. If the commission is cancelled (by me or the client) before work has started, then the client will receive a full refund.II. If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion. I do have a rough basis for refunds (This include Render Art):
● 100% if no steps have been taken at all.
● 75% of the sketch has begun.
● 50% if lining has begun.
● 25% if flat color has begun.
● Once the artwork is shading/nearly completed/completed no refunds are available.III. I will notify you as soon as possible of any issues that come up to keep you informed.IV. The artist reserves the right to cancel a commission at any time, for any reason, and without explanation.V. If I cancel the commission due to my inability to complete it at any state, a full refund will be given.VI. If you use the digital product after getting a refund you, you are fully aware of the possibility of legal actions.VII. Any attempts of chargeback will be considered bad faith by the buyer and will result in blacklist of character rights/art made.

SECTION VIII. REFERENCES AND INFORMATION

I. Maintain professional conduct throughout the commission process.Respond in a timely fashion.II. Discussion of commissions can be conducted via Notes (NOT CHAT), Art, or Discord (ImpishlyJynxed).III. Clients must provide at least one clear and concise visual reference, reference sheet, written references, or mood boards. I reserve the right to add a charge onto the order and will contact you about it and know that I am not responsible for any mistakes made.IV. I will still try my best to draw the character faithfully. Excess edits to match beyond what is presented to me at time of commission can absolutely tack on pricing, and I will let you know beforehand.V. Design interpretations may be inconsistent between images and lessen my ability to accurately draw your character. Shading on potential pieces will also play a part in this.VI. Please be as specific as possible when ordering. I love to work off of artistic freedom when possible, but if you are wanting something exact, I will need exact information.VII. Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.VIII. I reserve my right to refuse to emulate another artist's style. I work on my own style, and while references and requests to make things more cartoony/anime/manga is fine, asking me to "draw like [insertname]" is not.

SECTION IX. WILL/WON'T DRAW

I. Below is a general guideline for what I will or will not draw. Please keep my art style in mind when ordering; I will not try to match another artist's or company's art style (example: Disney style, Pokemon style, etc.)

● Any sort of hateful content, such as racism, transphobia, homophobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.You must be over the age of 18 to commission adult content. I am a United States citizen and abide by United States laws. Breaking this rule is extremely serious and will result in blacklisting/blocking on all social media, email, and any other means of contact. By ordering anything 18+/NSFW you are agreeing that you are at or above the age of 18.

SECTION X. WORKFLOW PROCESS

I. I work best when given some artistic freedom to create an image based on the characters you provide. I am happy to match a scene or pose that you have in mind, but please allow and expect some variation.II. Estimated date to completion. If there are any delays in completion of a commission, I will personally notify the customer.III. Completion of most commissions are generally estimated to take no more than roughly 1 week to 3 months. If for any reason I cannot complete a commission within 5 months of ordering, I will issue a full refund.IV. Works in Progress (WIPS). I will send any WIPs to the commissioner in a note, email, or over Discord. Progress will be paused until the draft/sketch is confirmed. Side Note: Draft/Sketch and subsequent in-progress shots will initially be sent as low-res, watermarked images.V. After the draft/sketch has been approved, no major edits or changes will be made. If the commissioner requests additional edits after the approved sketch, a price for the edits may be discussed.VI. If I, the artist, make any errors in the character design, accessories, or any other visual elements specified in the provided visual references, I will make these edits at no additional cost.VII. I will send you a full resolution image of .png or jpeg (by email or via google docs), but my signature will remain on both the full resolution and smaller versions of the Artwork.VIII. If you do not want me to post your commission online, you must tell me when you order.

SECTION XI. REVISIONS AND EDITS

I. If the commission type includes a sketch approval stage, any major changes or revisions must be made at this stage; this includes any significant changes to a character’s pose or body shape, or redrawing parts of the image.II. You will be sent a draft/sketch in which you will be able to tell me what you want fixed/changed, removed, or added, or if I'm allowed to continue.III. It is up to my discretion as to what constitutes minor and major revisions.
● Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.
● Additional major revisions will incur additional fees.
Anything I missed from the given information or reference on the order form(s) will be changed for free.IV. I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.V. Each time I send a WIP to a client, I ask the client to provide feedback to me. If no suggestions are requested the client is held responsible for dissatisfaction with incorrect details.VI. Any edits past 2 fixes during the sketch that weren't my responsibility, will cost a fee. Fee depends on complexity/number of extra changes. This is subject to change based on the amount of the sketch that is requested to be changed.VII. In the absence of feedback from the customer, any changes to the final piece will be subject to a fee.VIII. I will not redraw a completed commission unless payment is received for a second order.

SECTION XII. FINAL PRODUCT

I. There may be slight differences between the samples in my gallery and the illustration you will receive.II. The commissioner must respect that my artistic style cannot be altered.III. I reserve the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artistic quality of the piece.IV. Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion or loss.V. I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.VI. Feedback of the final product is permitted after completion of the piece, through private messages or comments.

By commissioning me, this means you have properly read, understand, and AGREE to the terms listed above and on the invoice.
